LGBTQ rights are fundamental human rights—including equality, non-discrimination, and safety—that vary significantly by country, ranging from legal protections and marriage equality in over 30 countries to criminalization in others. Key issues include legal recognition of relationships, protection against discrimination, and rights for transgender individuals.

Global LGBTQ Rights Status

  • Marriage and Adoption: As of early 2025, 38 countries recognize same-sex marriage. Many countries in Europe, North America, and Latin America offer these rights, while they remain restricted in much of Asia, Africa, and the Middle East.
  • Decriminalization: Global advocacy focuses on repealing laws that criminalize consensual same-sex relationships.
  • Transgender Rights: Rights vary from self-determination laws allowing legal gender changes to severe restrictions or lack of recognition.
  • Regional Variation: LGBTQ rights are often protected in Western countries, but and in many places, they are not protected to the same extent as the rights of straight and cisgender people. 

LGBTQ Rights in the United States

  • Non-Discrimination: Following the Bostock v. Clayton County supreme court decision, federal civil rights law prohibits employment discrimination based on sexual orientation and gender identity.
  • Marriage Equality: Same-sex marriage is legal nationwide, established by the Supreme Court.
  • Legislative Gaps: There is no comprehensive federal law prohibiting discrimination in public spaces, housing, or services, though the proposed Equality Act aims to fill these gaps.
  • Current Focus: Advocacy groups like the ACLU are actively tracking and opposing state-level restrictions on transgender rights
